Officer WHS "Due Diligence" Compliance Assessment

Aim:
 

To perform an inspection, assessment, and report on the “reasonable steps to be taken” that are required of the Officers (company directors, CEOs, other executive officers) of an organisation to ensure that the duties of the business or organisation (PCBU) are being carried out as per requirements of the NSW WHS Act 2011 and WHS Regulation 2025, and to make appropriate recommendations for improved compliance with these duties.

Assessment Criteria:

 

This service is delivered at your work premises. Our consultant will need to converse with the officers of your business and obtain information to conduct the assessment. A face-to-face visit and meeting are required.

Compliance with Section 27 of the WHS Act is evaluated based on the extent to which the mandatory due diligence actions are undertaken to ensure that their organisation is in compliance with WHS law.

Including examples given in Section 27, this amounts to 11 actions that every business owner and company director is accountable for. These are non-delegable duties (cannot be passed over to someone else.)


Objectives:

  1. Auditing the actions of the Directors/CEOs of the organisation against their mandatory duties of Officers as per Section 27 of the NSW WHS Act 2011 and related applicable Clauses of the NSW WHS Regulation 2025.
     

  2. Providing a report with recommendations for any identified actions of the Officers that can be improved, and recommendations for any improvements to processes or resources that may better assist them to carry out their mandatory duties.


Auditor:

A qualified and experienced WHS consultant and auditor.

Duration:

 

Most will take 2-3 days, but this is dependent on the size of the company, and the structure of the corporation and the number of officers. Further training or consulting services may be recommended upon completion of the assessment. There is no obligation to engage in further services with Courtenell.
