CONSULTATION COMPLIANCE IN NSW
Does your managers and workers know how a committee may assist with the facilitation of the consultation process between PCBU and workers as well as any other health and safety functions or management systems the safety committee may be involved in?
Do they know about SafeWork NSW’s Work Health & Safety Roadmap for NSW 2022 and explain how consultation and communication is a key element of the “Health and Safety Landscape.”?

To provide participants with the necessary knowledge and awareness of the requirements for businesses and other organizations in NSW to have consultation arrangements in place in matters of health and safety as per the WHS Act 2011, the
Consultation Cooperation and Coordination Code of Practice, and Worker Representation & Participation Guide.
On completion of this training, participants should be able to:
Explain what is PCBU Primary Duty Of Care.
Explain the requirement of the PCBU to consult with workers on matters of health and safety and when that is required.
Explain how and why Health & Safety Representatives are established and their role in relation to the PCBU’s duty to consult.
Explain what recourse options exists if negotiations fail in establishing consultation arrangements, and the resolution process.
Describe what the PCBU must discuss with HSRs and workers during the consultation process.
Describe the functions and purpose of a health and safety committee, when a committee may be necessary, and how it may additionally assist the consultation process between PCBU and workers.
Describe how consultation compliance aligns with SafeWork NSW’s Work Health & Safety Roadmap for NSW 2022.
Express confidence that they can contribute positively to their own consultation arrangements so as to be in compliance with WHS Law.
Who Should Do the Course?
This course is for all managers and workers, including HSRs and HSC members who need to be involved in the WHS consultation process required of all businesses and other organisations under WHS law.
This course suits businesses which have undergone changes requiring consultation to be re-established or improved, as well as for businesses which have had non-formal consultation arrangements and are now required or looking to formalize these in alignment with the recommendations of the WHS legislation.
