Industrial Deaths Federal Government Inquiry The subject of industrial deaths continues to attract attention. In October 2017 the Queensland government added a new offence called industrial manslaughter to their WHS Act. You can see the details of that in the article that Courtenell published at that time on our website https://www.courtenell.com.au/workplace-health-and-safety/industrial_manslaughter-a_new_whs_offence.html

On 26 March 2018, the Senate commenced an Inquiry into Industrial Deaths in Australia. The inquiry is focussed on the framework surrounding the prevention, investigation, and prosecution of industrial deaths in Australia with particular reference to:

  • the effectiveness and extent of the harmonisation of workplace safety legislation between the states, territories and Commonwealth;

  • jurisdictional issues surrounding workplace investigations which cross state and territory boundaries;

  • issues relating to reporting, monitoring and chains of responsibility between states, territories and the Commonwealth;

  • safety implications relating to the increased use of temporary and labour hire workers;

  • the role of employers and unions in creating a safe-work culture;

  • the effectiveness of penalties in situations where an employer has been convicted of an offence relating to a serious accident or death;

  • and any other related matters.

The closing date for submissions to the Inquiry is 6 June 2018 and you can see how to make a submission at this link: https://www.aph.gov.au/Parliamentary_Business/Committees/Senate/Education_and_Employment/IndustrialdeathsinAus
